Can I Be Sued
For Credit Card Debt
Can I be sued for credit card debt? Sure you can, after a
long process with lots of steps. If you are behind in your
credit card payments, at some point you will receive a letter
threatening to sue you. There will be many of these threats
before a lawsuit starts. The goal is to start you paying again
so there profit steam will start again. The lawsuit is real
when you get summoned to court.
In most cases, the debt is charged off
as a loss. Do not think you are free and clear at that point.
This is when the junk debt collectors start calling you. These
companies are by many names, the ones you hear about calling
people at night and at the workplace. Maybe a financial health check could be in
order
Before the junk debt collectors pick up these debts the
credit card company will try to use a debt collection agency
first. The
solution to credit card debt is to take care of it before
it gets to them in the first place. This is used for small
debts that are not worth the cost of court. It is always
preferable to avoid letting things get this far out of handin
the first place by calling the credit card company and working
out a payment plan.
"Never Spend Your Money Before You Have It." ~Thomas Jefferson
These debt collectors have bought up these
charged off debts from the credit card company for
pennies on the dollar. When you are notified by these
companies, you must respond to them or a default judgment is
made against you and settling
credit card debt will be a bit harder. This is
when a garnishment can be made against you. Contest the debt
in writing, it will give you more time to come up with money
to pay them.
"I believe that banking institutions are more dangerous
to our liberties than standing armies."
~Thomas Jefferson
